French Court Rules That 11-Year-Old Girl Had 'Consensual Sex' With Adult Male

A 28-year-old man who lured an 11-year-old girl into a stairwell for sex was put on trial in a French court, but was cleared of charges when the court decided the sex was consensual. Child advocacy groups around the world are outraged by the ruling, noting that children cannot give consent. The two had sex at least three times.

The man admits he lured the 11-year-old girl into sex, but he claims he didn't know her age and thought she was much older. He and the child had sex twice in a park near Paris and once in the stairwell of his apartment.

According to the girl, the grown-up promised to teach her how to be a good kisser. She agreed to go back to his apartment with him when he pulled her into the stairwell. The encounter turned into much more than kissing.

The girl finally admitted to her parents what had happened, and her parents called police. Police picked up the father of two and he was initially charged with rape. A French court, however, ruled that there was no evidence of violence or threats.

The girl's attorney argues that 'the man was assertive with her and threatened her with repute', but the court refused to hear it. According to French law, rape is only charged when there is proof of threats and violence. The attorney failed to meet the burden of proof to show that the girl had been threatened or restrained in any way.

“We should not even have this debate when it comes to a child,” said Carine Diebolt, the girl’s attorney. “There is a difference between curiosity and consent to a sexual act with a 28-year-old guy in a staircase.”

The girl’s mother says the child didn’t know what was coming when the grown man began taking advantage of her, and she just responded on ‘autopilot’ to the man’s advances because she was in shock and didn’t know what to do.

“She thought it was too late, that she didn’t have the right to protest, that it wouldn’t make any difference, so she went into autopilot, without emotion and without reaction,” said the girl's heartbroken mother.

La Voix de l’Enfant, a children's rights group, was shocked by the court's ruling and released a statement. "The question of consent or its absence should never be asked for rape victims who are minors," it read. They argue that the age of consent is 15, and children under that age should never be considered as someone able to give consent.

"Submitting is not consenting," said an expert to Le Figaro, a French newspaper. "Rape victims sometimes witch off and no longer feel fear. This is especially true among child victims."

People on social media expressed outrage over the ruling that said that sex between the 11-year-old girl and the 28-year-old man could be considered a 'consensual sex' encounter.

The man's rape charges were dropped, but he will face charges of sexual assault of a minor. He has another court date scheduled for February.
